WhatsApp Business API Prohibited Businesses in India
The short answer
The WhatsApp Business Messaging Policy, last updated 23 September 2026, prohibits 15 categories of goods and services, including alcohol and tobacco, drugs, real-money gambling, multi-level marketing, dating, and payday loans, peer-to-peer lending and debt collection, irrespective of any licence held. India appears on only one exception list: over-the-counter drugs (checked October 2026).
Which businesses does the WhatsApp Business API prohibit in India?
The WhatsApp Business Messaging Policy prohibits fifteen categories of goods and services, and an Indian business in any of them cannot use the WhatsApp Business Platform to buy, sell or promote them. The policy page reads "Last updated: September 23, 2026" (WhatsApp Business Messaging Policy), and that is the version quoted on this page, read on 16 October 2026.
Three of those categories have a way back in, through country lists for what Meta calls Regulated Verticals. India is on exactly one of the three: over-the-counter drugs. It is on neither the alcohol list nor the online gambling and gaming list.
The rest of the list has no country exception at all. Debt collection, payday loans, peer-to-peer lending, multi-level marketing and dating services are refused everywhere, and the policy ends the list with a sentence every licensed Indian business should read twice:
"These prohibitions apply irrespective of the global or local licenses, registrations, or other approvals your business may hold." (WhatsApp Business Messaging Policy)
This page reports what Meta's pages say, not legal advice. Where two Meta pages disagree, it quotes both.

What does the prohibited list in the Business Messaging Policy actually say?
Section 4 of the policy names fifteen categories and reserves the decision about which one you fall into to Meta. Its opening line is:
"We prohibit use of WhatsApp for Business for buying, selling, promoting, or otherwise facilitating the exchange of certain regulated or restricted goods and services listed below, as determined in our sole discretion." (WhatsApp Business Messaging Policy)
The fifteen items, word for word as the page lists them:
- Firearms
- Alcohol and tobacco
- Drugs, whether prescription, recreational, or otherwise
- Medical and healthcare products
- Endangered species (wildlife and plants)
- Live non-endangered animals excluding livestock
- Hazardous goods and materials
- Real, virtual, or fake currency, including ICOs and binary options
- Body parts or fluids
- Business models, goods, items, or services that we determine may be or are fraudulent, misleading, offensive, or deceptive, or may be or are exploitative, inappropriate, or exert undue pressure on targeted groups
- Real Money Gambling and Gaming (Online Gambling and Gaming is a subset of Real Money Gambling and Gaming. See Section 5 and Section 6 for limited exceptions.)
- Adult products and services
- Dating services
- Multi-level marketing
- Payday loans, paycheck advances, peer-to-peer lending, debt collection, and bail bonds
"WhatsApp for Business" is the policy's own umbrella. It lists "The WhatsApp Business App" and "The WhatsApp Business Platform" as the services it governs, so nothing here is an API-only rule.
Meta does not translate the list into Indian business types. The table is our reading of where common Indian businesses land.
| Policy item (Meta's words) | Indian businesses it usually reaches (our reading) | Exception for India? |
|---|---|---|
| Payday loans … debt collection | Instant-loan apps, recovery agencies, P2P lending platforms | None anywhere |
| Multi-level marketing | Network-marketing schemes | None anywhere |
| Real Money Gambling and Gaming | Fantasy sports, rummy and poker apps, betting | No |
| Alcohol and tobacco | Liquor stores, tobacco and vape sellers | No |
| Drugs, whether prescription … | Pharmacies and e-pharmacies | Over-the-counter only |
| Real, virtual, or fake currency | Crypto exchanges, currency dealers | None anywhere |
| Dating services | Dating apps | None anywhere |
Which regulated verticals have country exceptions, and is India on any list?
Three do, and India is on one. Section 5 of the policy opens the door narrowly:
"We allow the use of the WhatsApp Business Platform, for messaging about the Regulated Verticals listed below in this Section 5, in limited countries, and pursuant to applicable law." (WhatsApp Business Messaging Policy)
| Regulated vertical | Countries on Meta's list | India listed? |
|---|---|---|
| Online Gambling and Gaming | 5: Australia, Japan, Colombia, Mexico, Peru | No |
| Over-the-Counter Drugs | 87 | Yes |
| Alcohol | 82 | No |
The counts are ours, taken from the full lists on the policy page on 16 October 2026. Five countries are on the over-the-counter list and missing from the alcohol list: Bangladesh, Brunei, India, Nepal and Thailand. Sri Lanka, Bhutan and the Maldives are on both. The United States, the United Kingdom, the United Arab Emirates and Pakistan are on neither, which matters to an Indian brand selling abroad, because the list decides where the messages may go, not only where the business sits: "You must not use the WhatsApp Business Platform to send messages about Regulated Verticals outside of the allowed countries."
Listing comes with conditions:
- "You are prohibited from messaging about any Regulated Verticals on the WhatsApp Business App."
- "You are prohibited from providing any commerce experiences to buy or sell goods or services that are Regulated Verticals (see Policy for WhatsApp Commerce Features below)."
- "You must ensure that you have all required licenses, notices, permits and registrations."
- "You must immediately stop sending messages to users in the allowed country if your required license expires, is modified, or is terminated."
- "Messaging about any Regulated Vertical using the WhatsApp Business Platform may not be sent to people under 18 years of age."
The first of those is the one Indian shopkeepers trip on. The exception lives only on the Platform, so a chemist promoting over-the-counter products from the green WhatsApp Business app on the counter phone has nothing to stand on. The difference between the WhatsApp Business app and the API is usually framed as features; here it is the whole permission.
Can a loan app, NBFC or recovery agency use the WhatsApp Business API?
A recovery agency cannot: debt collection is on the prohibited list with no country exception. A lender's position depends on what it lends, because the policy names "Payday loans, paycheck advances, peer-to-peer lending, debt collection, and bail bonds" rather than lending in general.
The licence sentence bites hardest in this sector. An RBI registration, an NBFC licence or a state money-lending licence is exactly what the policy means by "local licenses, registrations, or other approvals", and the prohibitions apply "irrespective" of them.
Meta's list of violation types files these businesses under deception rather than finance: its MISLEADING entry covers business models Meta determines "may be or are fraudulent, misleading, offensive, or deceptive" (Meta — WhatsApp Business Platform Policy Violations), and its examples include "Payday loans, paycheck advances, P2P lending, debt collection, and bail bonds", beside "Multilevel marketing" and "Penny auctions".
What no Meta page read for this article does is define "payday loan" or "debt collection". Whether an EMI reminder a bank sends about its own loan counts as collection is not answered anywhere in the policy, the violations list or Meta's help article on the two policies.
One rule applies to every lender whatever its category: "Don't share or ask people to share full length individual payment card numbers, financial account numbers, personal ID card numbers, or other sensitive identifiers."
Can a pharmacy in India send WhatsApp messages about medicines?
For prescription drugs, no, on every Meta page. For over-the-counter drugs, Meta's policy says yes on the Platform, with conditions, and Meta's own help article says no.
The policy's exception text for over-the-counter drugs is:
"WhatsApp Business messaging that promotes over-the-counter drugs must comply with all applicable local laws, required or established industry codes, guidelines, licenses and must comply with age and country requirements consistent with applicable local laws." (WhatsApp Business Messaging Policy)
India is on that list. The WhatsApp Help Center article on complying with both policies, which carries no date, says the opposite:
"Pharmaceuticals—which we define as prescription drugs, over-the-counter drugs, and medical devices—continue to be prohibited by both the Business Messaging Policy and the Commerce Policy." (WhatsApp Help Center — How to comply with the WhatsApp Business Messaging and Commerce policies)
It repeats the point a few lines later: "neither prescription or over-the-counter drugs can be directly sold or promoted within the WhatsApp business services."
The help article defers to the policies for the current list. Its closing section says: "Review the Business Messaging and Commerce policies for an up-to-date list of goods and services that are prohibited from being sold or promoted on WhatsApp Business." The policy is dated 23 September 2026; the article is undated and points back to the policies. That favours the policy's reading, but it does not withdraw the article's sentence, so a pharmacy planning over-the-counter promotions should expect a reviewer may be reading either page.
What the help article does allow is a long list of ordinary pharmacy work: "Pharmacies and drugstores may use all WhatsApp features for grocery and convenience items, but not for pharmaceuticals." It allows appointment scheduling, answering questions about medical services and about proper use of pharmaceuticals, and it adds that "Prescriptions written by a licensed medical practitioner can be shared on WhatsApp, as this is considered medical advice."
Meta's DRUGS violation entry draws a line Indian manufacturers should know: "Manufacturers and healthcare services who do not engage in direct sale are allowed."
Health data has its own clause, and it defers to applicable regulations: "Don't use WhatsApp for telemedicine or to send or request any health related information, if applicable regulations prohibit distribution of such information to systems that do not meet heightened requirements to handle health related information." Clinics running reminders will find the practical version in our healthcare use case.
Is fantasy sports or real-money gaming allowed on WhatsApp in India?
No. India is not one of the five countries on the online gambling and gaming list, and the policy's definition names fantasy sports explicitly.
"We define online gambling and gaming as any product or service where anything of monetary value is included as part of entry or prize." (WhatsApp Business Messaging Policy)
The examples that follow are "betting, lotteries, raffles, casino games, fantasy sports, bingo, poker, skill game tournaments, and sweepstakes". Skill games are on that list. Meta's definition turns on money at entry or prize, not on skill versus chance.
Even in the five allowed countries, the route runs through Meta: "Request permission from Meta Platforms, Inc. using this application form. Note that businesses can only apply to message people in certain countries." The policy also defers to local law in so many words: "Within Real Money Gambling and Gaming, if your country/region prohibits certain activities such as gambling, games of chance/skill, and/or any other related activities, then your use of business messaging should not include such prohibited activities and should only include those activities which are lawful."
India's government describes its own law, the Promotion and Regulation of Online Gaming Act, 2025, this way:
"The Gaming Act comprehensively prohibits all forms of online money games, whether involving games of chance, games of skill, or any combination thereof. It also prohibits the advertising, promotion, and facilitation of such games, as well as the processing of related financial transactions through banks or payment systems." (Press Information Bureau, 18 March 2026)
Meta lists four activities that need no permission from it, including "Entirely free-to-play games", though they must still "comply with all applicable local laws".
Can a liquor shop or tobacco seller in India use WhatsApp Business?
Not to sell or promote alcohol or tobacco. India is not on the alcohol list, and tobacco, which shares a line with alcohol in the prohibited list, has no exception list at all.
Meta's help article draws the line at the business model:
"If the business’s primary business model is the sale of alcohol (including alcoholic beverages and kits for producing alcohol), they can’t use WhatsApp Business Services." (WhatsApp Help Center)
A retailer for whom alcohol is one line among many may message about the rest, but "They can’t list alcohol in product catalogs or promote or advertise alcohol in messaging." The two Meta pages part company on related goods. The help article names "glasses, coolers, wine bottle holders, and books or DVDs about alcohol" among the other goods such a retailer may sell, while Meta's violations page lists "Alcohol-related items, including glasses, coolers, and wine bottle holders" as examples under ALCOHOL. A bar-supplies shop is closer to the line than the help article alone suggests.
The TOBACCO examples list "Hookahs" and "Electronic cigarettes (E-cigarettes) or tobacco devices" alongside cigarettes, so hookah and vape sellers are inside the category on Meta's own wording.
Are MLM, dating and crypto businesses allowed on the WhatsApp Business Platform?
No. "Multi-level marketing", "Dating services" and "Real, virtual, or fake currency, including ICOs and binary options" are all on the prohibited list, and none has a country exception.
Meta's help article spells out what counts as currency. Its examples of prohibited real currency include "Gift cards" and "Prepaid debit cards", and its examples of virtual currency are "Game currency" and "Cryptocurrency". The DATING violation entry is narrower than the policy line: "Businesses may not transact in or facilitate online dating services."
Multi-level marketing is not defined on the policy page, and none of the Meta pages quoted here uses the term "direct selling" or any Indian legal category. A registration under Indian direct-selling rules is a registration, and the policy's licence sentence applies to registrations by name.
How is the Commerce Policy different from the Business Messaging Policy?
The Business Messaging Policy decides whether you may be on WhatsApp at all. The Commerce Policy decides whether you may sell through WhatsApp's commerce features, such as the catalog and payments.
"The Commerce Policy is used to govern whether businesses can sell their products and services using WhatsApp commerce product features like catalog and payments." (WhatsApp Help Center)
The same article adds: "Businesses selling products and services prohibited by the WhatsApp Commerce Policy can still use WhatsApp for messaging and most features, excluding commerce product features like product catalogs or payments." It applies the same split to businesses selling digital subscriptions and services, which may onboard for business messaging "but they can’t use WhatsApp commerce product features."
The help article's link to the WhatsApp Commerce Policy no longer leads to a page of its own. When we opened whatsapp.com/legal/commerce-policy/ on 16 October 2026 it redirected to the Business Messaging Policy, whose commerce section sends you on to the Meta Commerce Policy, a page that carries no date. Three lines there matter to Indian sellers:
- "Commerce content may not promote the buying, selling or trading of services, except on the WhatsApp Business app or through Appointments in Facebook or Instagram."
- "Commerce content may not promote the buying, selling or trading of medical and healthcare products and services, including medical devices or ingestible supplements."
- "Commerce content may not promote job opportunities."
The first of those surprises service businesses. A coaching centre or a salon can message on the Platform, but on that wording its services do not belong in a Platform catalog. Meta's help article, meanwhile, says "Services like mobile recharges, cable TV packages, and internet packs are allowed for sale on WhatsApp." Meta's display-name guidelines add that where a company holds separate accounts for its divisions, "only divisions that comply with WhatsApp's Commerce policy (the policy governing which goods and services may be sold on WhatsApp) may hold a WhatsApp Business account" (Meta — Display name guidelines).
Customers will still ask. Meta's instruction for that moment: "If a customer begins a conversation about a prohibited good or service, instruct them to continue that conversation on a different channel."

That redirect is a sentence your team will type often. In WabaCRM it is a quick reply, saved once, shared with the team and inserted by typing / in the inbox composer.
Can a political party, candidate or government department use the API?
Political parties, politicians, candidates and campaigns cannot. Government entities can, but only through a Solution Provider.
The policy's government section sets four rules, and three of them are prohibitions:
"We prohibit the use of the WhatsApp Business Platform by Political Parties, Politicians, Political Candidates, and Political Campaigns." (WhatsApp Business Messaging Policy)
It also prohibits use "by Law Enforcement Agencies, Military Services, National Security and Intelligence Agencies", and by "entities that offer services related to politics, political candidates, political campaign strategy, political campaigning services, private companies that provide voting solutions and systems for elections, and exclusive government service providers". In India that reaches political consultancies and election-tech vendors as well as parties.
For government bodies the policy says: "We permit the use of the WhatsApp Business Platform for government entities and require access through a Solution Provider (formerly known as Business Service Provider)." That parenthesis names an older label, and the policy does not map it onto the partner tiers Meta's partner documentation now uses. WabaCRM is a Meta-verified Tech Provider, not a Solution Partner, and the difference between a BSP and a Tech Provider is worth reading before a department picks a vendor. Confirm the route with Meta first.
What happens when Meta decides your business falls in a prohibited category?
Meta records a policy violation against the WhatsApp Business Account, emails its admins, sends an account_update webhook naming the violation type to anyone subscribed, and escalates restrictions on repeat. In severe cases it offboards the account at once.
Meta's enforcement guide, updated 21 May 2026, names the categories it treats as high risk: "high-risk policy categories such as adult content, sale of alcohol and tobacco, drugs, gambling and unsafe supplements". It also says: "In some cases, where there is evidence of a policy violation that causes severe harm to our users, such as child exploitation, scams, terrorism, or the sale of illegal drugs, WhatsApp will immediately offboard these Business accounts." (Meta — WhatsApp Business Platform policy and spam enforcement)
The webhook arrives on the account_update field. This is Meta's own example from the reference page, updated 2 October 2026:

Source: Meta — account_update webhook reference. The violation_type values come from Meta's violations list, which on 16 October 2026 carried nineteen, among them GAMBLING, DRUGS, HEALTHCARE, ALCOHOL, TOBACCO, MISLEADING, REAL_FAKE_CURRENCY, DATING and SUPPLEMENTS. Meta adds: "We may adjust this list over time."
On appeals, the enforcement guide says "Violations might be appealed or acknowledged, based on violation type and eligibility", and the deadlines and steps are in what to do when a WhatsApp Business account is restricted. The policy's last word on the matter is the one to weigh before connecting a number at all: "If we terminate your account for violations of our terms of service, the Business Messaging Policy, or the WhatsApp Messaging Guidelines, we may prohibit you and your organization from all future use of WhatsApp products and services."
Before you connect, find your category in the fifteen; if it is a Regulated Vertical, confirm India is on that list today and that you will message from the Platform. The ordinary rules still apply on top, including what WhatsApp actually requires from an opt-in.
Every Meta quotation on this page was read from Meta's own documentation on 16 October 2026. Meta changes that documentation without notice; the linked pages are authoritative and this one is not.
